NGT extends the total ban on the sale and use of firecrackers

The National Green Court (NGT) on Wednesday ordered a total ban on the sale and use of firecrackers during the COVID-19 pandemic in the National Capital Region (NCR) and in all cities and towns where the ambient air quality be deficient or superior. categories.

A bank headed by NGT President Judge Adarsh Kumar Goel also ordered that only green cookies will be allowed for Christmas and New Years, between 11:55 p.m. and 12:30 a.m., in areas where the quality of the room air is in the moderate or lower categories. .

All district magistrates have been ordered to ensure that firecrackers are not sold and that offenders’ compensation is recovered.

“The district magistrate, in a complaint or otherwise, will recover compensation from the offenders … Any contamination victim, in addition to other remedies, may go to the district magistrate to obtain compensation, showing evidence of individual harm and the person responsible for the damage said claim may be dealt with by means of a reasoned order, “said the Court.

The green panel also specified that in order to ensure the availability of air quality data, the installation of at least one air quality monitoring station is required at each district headquarters.

“Where there is no such monitoring station, at least one manual monitoring station that is very easy to set up and inexpensive should be installed as soon as possible … this should not exceed three months in any case,” the Bank said.

Noting that the opposition to the arguments against the use of firecrackers were from the firecracker manufacturers, the bank observed: “The right to do business is not absolute. There is no right to violate air quality and noise standards. This being a crime according to the law of the country cannot be a right. No one has the right to conduct business at the expense of the health of others. All licenses already granted or that may be granted are intrinsically subject to the primary requirement of preventing damage to the environment and public health. “
