NEW DELHI: The National Investigative Agency (NIA) on Sunday called reports “false, incorrect and mischievous” that it had recovered straw and sip of Stan swamy, a defendant in the case ‘Bhima Koregaon-Elgar Parishad’ who allegedly suffers from Parkinson’s disease, and requested a period of 20 days in court to respond to his request to allow him these two items in the central jail of Taloja.
Stating that it had conducted the personal search for Father Stan in the presence of independent witnesses, the NIA insisted in a statement that no straws or dinners were found during the search. “The NIA did not recover a sip or a straw from the defendant nor did it request a period of 20 days to submit a response to said request,” he said.
Furthermore, he said that after arresting Stan Swamy on October 8, 2020, he presented him to the Special Court in Mumbai along with the charge sheet on October 9, 2020 and never took his police custody.
“All the necessary legal formalities, such as his medical examination, etc., were duly observed. Since then, the defendant Stan Swamy has been in judicial custody at the Taloja Central Jail. “As the defendant was in judicial custody, the matter was between him and the prison authorities reporting to the Maharashtra State Administration,” the central investigative agency said.
Stan Swamy had filed an application on November 6, nearly a month after he was arrested and a charge sheet was filed against his arrest, in the Honorable NIA Court in Mumbai for recovering his straw and sip, which he falsely claimed to have been maintained by NIA. Subsequently, the court requested the NIA to submit its response on the next date, which was scheduled for 11/26/2020.
The NIA duly filed its response with the Court on the due date, that is, November 26, 2020, stating that the NIA had carried out its personal search in the presence of independent witnesses and that no such straws or straws were found. sips. Defendant Stan Swamy was arrested by the NIA on October 8, 2020, for his involvement in the activities of the (Maoist) CPI and for promoting the agenda of the banned terrorist organization as one of the conspirators in the parishad case of Bhima Koregaon Elgar. .
The case concerns widespread violence, arson and stoning that resulted in loss of life and property near Bhima Koregaon, as a result of provocative speeches during the organization of the Elgar Parishad program in Shaniwarwada, Pune, on December 31. of 2017.
The Honorable Court rejected Swamy’s request and issued the necessary instructions to the jail authorities on November 26, 2020 to provide him with straw and sips. Stan Swamy, a staunch CPI activist (Maoist) was indicted by the NIA on November 9, 2020 along with seven other defendants for his role and involvement in the conspiracy of Bhima Koregaon Elgar Parishad.
“Stan Swamy was spreading among other cadres that the arrest of urban PCI (Maoist) cadres from different parts of the country, particularly in Maharashtra, has caused enormous irrevocable damage to the (Maoist) PCI. He received funds from other Maoist cadres to promote the activities of the PCI (Maoist). He is the convener of the PPSC, a front organization of the CPI (Maoist). The incriminating documents related to communications promoting the activities of the banned terrorist organization CPI (Maoist) were confiscated from their possession, ”the NIA said on Sunday.
