The National Investigative Agency (NIA) told the NIA special court Thursday that they don’t have a straw and a sip to give to 83-year-old Father Stan Swamy.

On November 6, Father Swamy submitted an application requesting permission to allow him a straw and a sip in Taloja Central Jail, as he cannot hold a glass because he has Parkinson’s disease.
On October 22, his medical bond was rejected by the same judge who relied on instructions from the high-powered committee set up to release pre-trial prisoners during the COVID-19 pandemic. The court said that “the defendant (Father Swamy) is involved in the commission of a crime punishable under the Prevention of Unlawful Activities Act cannot be said to be entitled to a provisional bond.”
The medical plea was requested on the grounds that he suffered from Parkinson’s disease and has almost lost hearing in both ears. He has landed in jail several times and has had hernia surgery twice and still has pain in his lower abdomen. Therefore, you need to be protected from COVID-19.
However, the court recorded: “The reasons given by the applicant (Father Swamy) for the granting of the bond do not reveal that the medical treatment provided to the applicant in prison is not sufficient. On the contrary, the applicant had submitted a request to instruct the prison authorities to provide him with the necessary comforts ”.
The court also mentioned that the Superintendent of Taloja Central had said: “As the plaintiff is an elderly person, he has been housed in a separate cell in the hospital / dispensary section. He does not even speak with the imagination that the plaintiff suffers from some disease for which treatment is not available in prison.
Father Swamy is accused of the 2018 Bhima Koregaon violence and is currently in the prison hospital. He was arrested by the central agency on October 8 from his residence in Ranchi and was taken to Mumbai the next day. The agency did not request his police custody and was in pretrial detention as of October 9.
