On Wednesday, the High Court dismissed the AAP government’s appeal against bail granted to Pinjra Tod activist Devangana Kalita in a case of violence in northeast Delhi.
A bank headed by Judge Ashok Bhushan dismissed the statement submitted by the Delhi government saying that being an influential person cannot be grounds for denying bail.
Additional Attorney General SV Raju, who appeared for the Delhi government, said Kalita is an influential person and the high court has stated that there were only police witnesses in the case. He said there are also some protected witnesses in the case.
The court asked Raju if an “influential person” could be grounds for denying bail. He asked the ASG how he can manipulate the witness.
The court said it would not interfere with the Delhi High Court’s decision to grant Kalita bail.
On September 1, the high court had granted bail to Kalita in a case of violence in northeast Delhi, saying that the police did not prove that he instigated women in a particular community or delivered hate speech, since she was seen in a peaceful upheaval that is her fundamental right.
