Center notifies J&K, Ladakh land laws, omits ‘permanent resident’ criteria


One notification says that the government can, upon written request from an Army officer not below the rank of Corps Commander, declare an area as a Strategic Area within a local area.

The Center has notified new laws, including fresh land laws, for the Union Territories (UT) of J&K and Ladakh and has omitted any preconditions for the purchase of land in J&K, as existed in Article 370 for foreigners.

By virtue of the recently enacted J&K Development Law (XIX of 1970), it notified that “omit, be a permanent resident of the State”.

In a new notice, Section 30 and Part VII of the State Land Acquisition Act, Samvat 1990 was replaced by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act of 2013 (30 of 2013).

By introducing the J&K Land Reform Act, the Jammu and Kashmir Forest Act of 1987 was also superseded by the India Forest Act of 1927 (16 of 1927).

The Center also completely repealed the J&K Land Alienation Act of 1995 and the J&K Large Land Holdings Act and the J&K Common Lands (Regulation) Act of 1956 and the J&K Tenure Consolidation Act of 1962.

The Center has repealed most of the previous land laws, including the J&K Farm Fragmentation Prevention Act of 1960; J&K Law of Prohibition of Land Conversion and Alienation of Orchards of 1975; the J&K Prior Purchase Right Act, 1936 AD; Section 3 of the J&K Tenancy (Suspension of Removal Proceedings) Act of 1966; the J&K Land Use Law, 2010; and the J&K Underground Services Act (Acquisition of User Rights to Land).
