Lead attorney Shyam Divan appearing on Viswam said the RBI issued an order in April 2018 asking these multinational companies to ensure that the data processed in these forums is protected on a server within India. This was to be fulfilled in October 2018, but it was not done, Divan added.

Furthermore, he informed the court that WhatsApp stores data with its parent company Facebook which has a server outside of India.

The court has also issued notices to the Reserve Bank of India (RBI) and the National Payments Corporation of India (NPCI). The petition presented through lawyer P Sriram said: “The RBI and NPCI, instead of investigating such accusations (of data protection) have turned a blind eye and have allowed the operation of Amazon, Google and WhatsApp on the platform UPI even against the public interest.
