Days after the Hathras incident, the Interior Ministry issues a new notice to states on women’s safety


Days after the death of a 19-year-old gang rape victim from Hathras, the Center issued an advisory to the states and territories of the union, directing them to ensure strict police action on crimes against women.

The notice issued by the Union Ministry of the Interior has compelled the police to register an FIR in a case of “offense recognizable under subsection (1) of section 154 of the Criminal Procedure Code (CrPC)”.

For crimes that are not under the jurisdiction of a police station, a FIR Zero must be registered, according to the notice of the Ministry of the Interior. Officials who do not present a FIR in relation to recognizable crimes will be sanctioned, he added.

“Section 166 A (c) of the Indian Penal Code 1860 (IPC) establishes the punishment of a public servant for not registering FIR in relation to recognizable offenses punishable under section 326A, Section 326B, Section 354, Section 354B, Section 370, Section 370A, Section 376, Section 376A, Section 376AB, Section 376B, Section 376C, Section 376D, Section 376DA, Section 376DB, Section 376E or Section 509 in IPC, ”the notice states.

The young woman died in Hathras after allegedly four men gang-raped her. They initially took her to Aligarh, but later transferred her to Delhi after her condition deteriorated. The woman later succumbed to injuries sustained during the gang rape.

The brutality of the crime shocked the entire country, sparking massive protests led by opposition parties and women activists.
