No Maratha Quota On Jobs, Admissions This Year, Supreme Court Says; BJP calls it ‘black day’ for the community

Government move rekindles Maratha quota debate in MaharashtraThe high court was hearing petitions challenging Maharashtra law granting reservations to Marathas on jobs and admissions.

The Supreme Court, in an interim order on Wednesday, ruled that the Maratha quota would not apply to jobs and admissions this year. The court has also referred the matter to the Chief Justice of India to set up a larger court for a further hearing.

However, the bench headed by Judge L Nageswara Rao said that admissions already made under the quota in graduate medicine courses will not be affected.

The high court was hearing petitions challenging Maharashtra law granting reservations to Marathas on jobs and admissions.

The petitions had challenged the June 2019 Bombay High Court order which, while upholding the law, also held that the 16 percent reservation was not justifiable, adding that the quota should not exceed 12 percent in employment and 13 percent in admissions to government-run educational institutes. In its verdict, the High Court relied heavily on the findings of the 11-member Maharashtra State Backward Class Commission (MSBCC). In its reports filed on November 15, 2018, the MSCCC had said that the Maratha community is socially, economically and educationally backward.

The Supreme Court had previously postponed the hearing and the state pledged not to conduct new recruits until September 15, 2020.

Leading advocates Mukul Rohatgi and PS Patwalia, who appeared for the state government, had told Justices LN Rao, Hemant Gupta and S Ravindra Bhat that the state had already decided by government resolution on May 4 that no new recruitment be made. .

Calling it a black day It is a “black day” for Marathas, the BJP attacked the Maharashtra government, saying that neither CM Uddhav Thackeray nor the head of the CPN, Sharad Pawar, paid any attention to the matter.

Former Maharashtra chief minister Devendra Fadnavis said that efforts made by the previous BJP-led government for the “comprehensive development” of the community had been “undone.” “The government (of the MVA) could have kept the quota intact if it had taken steps to trust everyone. But this government has not taken the issue seriously from the beginning, “he alleged.

Party deputy Narayan Rane accused the state government of not wanting to hand over the quota to the community. “They did not appoint a reputable lawyer to contest their case because they were not willing to give the fee. They appointed two ordinary lawyers ”, he alleged.
