NEW DELHI: The Supreme Court on Wednesday suspended the implementation of 2018 Maharashtra law granting reservation to Marathas in education and jobs, but made it clear that the situation of those who have benefited from the benefits will not be affected.
A three-judge bench headed by Justice LN Rao referred to a larger constitutional bench, to be established by Chief Justice of India SA Bobde, the batch of allegations challenging the validity of the law granting reservations to marathas in education and employment.
The superior court said the status of those who already benefited from the 2018 law will not be altered.
The Act on Socially and Educationally Backward Classes (SEBC) of 2018 was enacted to grant a reservation to persons of Maratha community in Maharashtra in jobs and admissions.
The Mumbai High Court, while upholding the law in June last year, held that the 16% reservation was not justifiable and said the quota should not exceed 12% in employment and 13% in admissions.
