Supreme Court rejects petition for review of six opposition-ruled states to postpone exams

The ministers in the guilty plea had claimed that the higher court order failed to secure the students’ “right to life” and ignored the “initial logistical difficulties” they will face when taking exams during the COVID-19 pandemic.

On August 28, ministers of state relocated SC and demanded that exams be postponed for at least six to eight weeks in light of the increase in coronavirus cases and student health concerns. He alleged that the government’s decision to continue with the examinations despite 3.3 million cases of covid with more than 60,000 deaths, “reveals the non-application of the mind and is an unreasonable, arbitrary and capricious exercise of power.” .

The request for review has been submitted by ministers from West Bengal (Moloy Ghatak), Jharkhand (Rameshwar Oraon), Rajasthan (Raghu Sharma), Chhattisgarh (Amarjeet Bhagat), Punjab (BS Sidhu) and Maharashtra (Uday Ravindra Sawant).

A bench of judges Ashok Bhushan, BR Gavai and Krishna Murari considered the reason for review in the chambers.

The review requests further stated that the NTA has ignored the logistical difficulties in conducting the exams on the proposed dates and has also failed to balance the competitive but equally crucial aspect of taking the exam and the safety of the students. Requesters for the review had also raised the issue of the lack of “mandatory safeguards” for conducting the reviews.

Earlier, on August 17, the Supreme Court headed by Judge Arun Mishra ordered the petition dismissed, saying that “the career of the students cannot be jeopardized for long.”

Judge Mishra had said: “Life cannot be stopped. We have to go ahead with all the safeguards and everything … Education must be opened. COVID can continue for one more year. Are you going to wait another year? You know what ? It is the loss for the country and the danger for the students. “
