Over two months since the Jammu and Kashmir administration began issuing certificates of domicile, the Union Territory Administration has issued around 12.5 lakh of such certificates as of August 31.
J&K management spokesperson Rohit Kansal said Tuesday that “more than 99 percent” of residency certificates have been issued to former holders of the Permanent Residence Certificate (PRC).
“We have been reviewing the process regularly and the certificate issuance process is recovering rapidly. More than 12.5 lakhs of certificates have already been issued and virtually all have been issued to holders of the People’s Republic of China, including Pandit migrants from Kashmir and others, ”Kansal said, adding that the process will be expedited and monitored. to ensure that processing takes place. to the lowest.
Chief Revenue Secretary Pawan Kotwal, who addressed the media along with Kansal, said that at least 20,000 requests for residency certificates were rejected in the details verification process.
He emphasized that from now on this certificate “has nothing to do with land rights. If you have this certificate, it does not entitle you to obtain land here, that’s a different matter. “
In April this year, six months after Jammu and Kashmir took shape as a Union Territory, the Center introduced the domicile clause that extends protections to those who have “resided for a period of fifteen years in J&K UT. or they have studied for a period of seven years and appeared in the 10th / 12th exam class at an educational institution located at UT de J&K ”.
Shortly thereafter, the government issued the Residence Certificate Granting Rules (Procedure), defining the requirements for the issuance of certificates and including in its scope West Pakistani Refugees, Safai Karmacharis and children of women married outside Jammu and Kashmir. . On June 22, former Lieutenant Governor GC Murmu launched an electronic application and a home certificate issuance portal, after which the roll-out of the certificates began.
Prior to this, Article 35A of the Constitution had empowered the J&K Assembly to define a J&K resident, who was the only one eligible to apply for employment or own real property.
“The government carried out a detailed review of the situation, in particular regarding pending applications and the time required for issuance, and on August 25 issued an SRO 263 that further simplifies the process for former holders of the People’s Republic of China by which the time for issuing these certificates was reduced from 15 days to five days. It was further ordered that for holders of the People’s Republic of China, no further investigation would be required and a certificate of domicile would be issued simply based on the availability of the People’s Republic of China, ”Kansal said.
He added that the administration is open to further reducing this time so that the certificates can be delivered “with the minimum possible difficulty and in the shortest possible time.”
