On Tuesday morning, the court ordered the release of the Gorakhpur doctor and overturned his detention under the strict National Security Law.

Family members of Dr. Kafeel Khan have said that they will file a contempt plea in Allahabad High Court on Wednesday if he was not released on their orders. The court had ordered the Gorakhpur doctor’s release and vacated his detention under the strict National Security Act (NSA). The doctor was arrested in January for an allegedly provocative speech during an anti-CAA protest at the Muslim University of Aligarh.
Khan has been housed in Mathura jail for nearly seven and a half months on charges of delivering inflammatory speeches in Aligarh against the Citizenship Amended Act (CAA) last year. After the order, his family went to jail for his release, but the authorities refused to release him, claiming they had not received the order.
Mathura Jail Chief Superintendent Shailendra Kumar Maitreya said he has not yet received court orders.
Mathura District Magistrate Sarvagya Ram Mishra said court orders will be followed. “Since the NSA was imposed on Kafeel by the Aligarh district magistrate, he should be contacted,” Mishra said.
Khan’s defender, Irfan Ghazi, alleged that Mishra does not give him time under the pretext of attending one meeting or another, despite hours of efforts made by him.
Despite repeated efforts, Aligarh DM Chandra Bhushan Singh could not be reached for comment.
Khan’s brother Adeel claimed that the Mathura prison administration told them that they will follow the order of the district magistrate and until the DM says, he will not be released.

Adeel claimed that following the High Court order, an email informing them of Khan’s release was sent to the Mathura Jail Administration and the Mathura and Aligarh DMs, but the authorities are “making an excuse” not to obtain the order.
If Khan is not released from jail, we will file a contempt appeal in Superior Court on Wednesday, he said.
