10 Indonesian Tablighis released on bail

Mumbai: A session court on Friday released ten Indonesian citizens on bail who were arrested for failing to disclose that they had attended the Tablighi Jamat meeting at Markaz Nizamuddin in Delhi. The court also granted provisional relief from arrest to two of them who were held in quarantine after testing positive for Covid-19.

Attorney Taraq Sayed and Ishrat Ali Khan appeared for the applicants, and Judge V. V. Kathare released the ten individuals on bail with a personal bail of Rs 25,000 each.

Bandra police had opposed the pre-arrest bail statement submitted by the remaining two people, but since the hearing is pending, the judge granted them provisional protection and deferred the hearing until May 11.

The applicants had claimed that the holy month of Ramadan is underway and that there are no adequate facilities in the prison for pre-dawn food and post-fasting Iftar food.

They also argued that the present case is a “classic example” of “misuse” of the powers of the police machinery by applying IPC sections 304 (guilty murder) and 307 (attempted murder) without supporting evidence. Despite having been negative for Covid-19, there was no need for his arrest and the same is an arbitrary exercise of powers.

According to them, there is no substance in the case that attracts IPC sections 307 and 304. They also argued that the claim made by the police that the applicants misused and manufactured passports is absolutely false. They said that the rest of the charges were available and should therefore be released on bail.

Bandra police had arrested ten people on April 23, as they failed to comply with the police notice. Police had previously issued a notice, warning people, who had attended the meeting in Delhi, to come forward if they failed to take legal action against them.
