Although FKF workers are required to wear protective gear, a mask, and gloves, many have been infected with the coronavirus. To date, at least sixty people have contracted the virus.

According to our source, so far the company has provided workers with two washable masks per person and one surgical mask per week. The disposable paper mask is effective against the virus for only 15 minutes indoors.

Also, garbage collection is a dangerous plant where there is a high risk of infection even without coronavirus.

Currently, the company is reorienting workers from other areas of the plant so that garbage transport in Buda is not in danger. If the Metropolitan Public Area Maintenance waste transportation department is threatened with downtime due to illness, disaster management must ensure replacement of waste conductors and loaders.

The utility provider retrains their worst case workers and existing staff so they can take on the responsibilities of infected workers.

Higher wages but greater danger

Approximately 20 people will participate in the OKJ training for earthmoving machine operators for FKF employees, and the number of theory classes for forklift drivers will be the same. Although all forms of education outside of primary school continue to operate in the digital space, in the absence of regulation, this no longer applies to adult education. Secondary schools, higher education is closed, there are also breaks in many kindergartens, but personal education is still mandatory for adult education students. Up to 40 people can sit on a mask in a room.

The training of forklift drivers and operators of earthmoving machines (garbage truck loaders), which began on November 16 and 17, was necessary because of the provision of other public services. Thus, in an emergency, newly trained workers can take the place of deserters.

The students were selected from the FKF staff for the course. Workers who have only eight general or high school graduates do well with the OKJ document because they are automatically placed in a higher salary category, but the company does not pay employees for after-hours training. Further

on the other hand, massively modifying recent job descriptions, (which does not require the consent of the employee), FKF may require its employees to perform extraordinary tasks. Including garbage washing and waste discharge.

FKF answered our question:

In the performance of our functions, it is essential to have a sufficient number of duly qualified employees at all times to be able to comply with our obligations established in the legislation and our public service contracts at the required and expected level even during the emergency.

To comply with current legal obligations, taking into account the personal safety of our employees, our employees need the appropriate professional and machine operator qualifications to operate the high-value machinery and equipment used in the performance of their work. By organizing the training that is currently taking place, we are meeting these legal obligations and our responsibility for the safety of our colleagues.

Are you going to bounce if you don’t become a garbage man?

According to our sources, the South Pest plant manager graciously pointed out to the workers that they would show a door to those who did not want to participate in the OKJ paid for by the FKF. The company responded:

Our employees receive a 100% corporate cost subsidy for training, but we are not required to participate. Employees who do not accept the conditions of the training have the opportunity to obtain, on their own account, the necessary qualifications in the training that they consider appropriate, but of course with the necessary accreditation.

Employees with OKJ role as earthmoving machine operator may even be transferred to the waste cargo, which is not very popular with employees participating in training, especially in view of the high rate of illness. The labor lawyer we interviewed, dr. Sarah Viszló said:

If the employer does not want to change the employment contract, but wants to temporarily employ his employee in another job, he has a limited opportunity to do so. You can “reassign” an employee to another job for up to 44 business days per year (or 352 hours), provided the conditions required to perform the tasks are met (eg, the employee has the necessary qualifications).

Most applied for training until the end of December, not on a voluntary basis, but to keep their jobs. At the same time, they fear that the company will continue to employ them in permanent waste loading jobs. However, according to the interpretation of the labor lawyer, despite the fact that the job description establishes that the assigned task cannot be rejected by the employee,

If the employer wishes to employ the employee in a new position, this requires a modification of the employment contract, which is only possible by mutual agreement.

However, the employer can also change the job description unilaterally, for example by formulating new tasks for the given job. This, in turn, has certain limitations. On the one hand, the amendment must not be of such magnitude that in practice it results in employment in another position, since it is an amendment to the contract, which also requires the consent of the employee. On the other hand, the changes must not harm the employee’s interests or cause him disproportionate harm.

This kind of change in job description can be considered a legal issue in any case, and the employee has the opportunity to challenge it within 30 days.
