The court now agreed with the ERRC’s earlier argument that the hospital directly discriminated on the grounds of wealth, social origin and maternity (pregnancy) as a protected characteristic and indirectly discriminated against Roma mothers who were disproportionately affected by the provision and therefore they were often forced to give birth alone.
