On January 31, the government created the Operational Team for the Control of the Coronavirus Epidemic, which was initially in charge of analyzing and evaluating the processes related to the spread of Covid-19 abroad. The national emergency was declared on March 11, a week after Prime Minister Viktor Orbán, as leader of the operational staff, announced on March 4 the first recorded case of the coronavirus epidemic in Hungary.
It can also define our daily life.
The first operational strain is 1012/2020. (I. 31.) Government Resolution, while the second (the first legal successor) is similar in content, but is at a higher level in the hierarchy of sources of law. (VI. 17.) Government Decree. That is to say
in the spring there is a government decision, and in the fall a government decree regulates the operation of operational personnel.
What is the fundamental difference between a government decision and a government decree? Well, a government decree is the highest level of legislation that the executive can enact, which can even determine our daily life (for example, traffic regulations or epidemiological restrictions are also regulated by a government decree). A government decision, on the other hand, is a lower-level standard that governs the tasks and operations of a government-run organization without the decision having a direct impact on people’s daily lives.
Authorized by law
Therefore, the operation of the operative strain is regulated by a government decree, based on an amendment to the Health Law in force since June 18, which empowers the government to establish an operative strain to control the epidemic and establish rules on its composition, organization and operation.
And the Public Procurement Law empowers the government to regulate it by decree.
- In the case of organizations financed by the Health Insurance Fund, the detailed rules for centralized procedures related to health services, the amount of the fee to be paid to the organization authorized to tender for centralized contracting, covering only those implementation costs, and
- special rules for public procurement of drugs, disinfectants and medical devices, which differ from this Law due to the specificities of said procedures.
Extremely wide reach
Not only does the operating tribe establish its own rules of procedure, it also has an extremely wide range of powers at the top. It is no exaggeration to say that at the time of the epidemic the government was in government.
Article 232 / D of the Health Law. § (1), you can make proposals, discuss proposals or present them to the government.
In the framework of epidemiological preparation, in a government decree
- may be restricted or prohibited
– the operation of all institutions and establishments, the attendance and organization of events and the carrying out of activities that may contribute to the spread of an epidemic – operation and opening of stores,
– traffic of passengers, livestock or goods between certain areas of the country and between Hungary and another country,
– personal contact between certain areas of the country and the inhabitants of Hungary and other countries,
– visits to certain institutions, in particular outpatient clinics, inpatient clinics and public education, professional training, higher education, social, child protection, child welfare and public education institutions,
– leaving certain areas,
– sale, consumption, purchase of certain foods, products,
– drinking water consumption,
– have certain animals,
- a measure may be taken regarding the supply of medicines and medical aids and the procedure for accessing health services,
- The necessary measures can be introduced to preserve the state of the medical supply, so that the participation of the Hungarian Police and Armed Forces, the forces of order and the Hungarian Armed Forces can be counted on. can be extended to an institution that provides long-term or temporary care for the elderly,
- establish rules on social distance and the use of protective equipment to reduce the risk of infection, as well as a time limit for purchases in shops and markets exclusively by the groups most at risk of contracting the disease caused by the epidemic ,
- make provisions for public education, higher education, vocational training and adult education,
- impose a traffic restriction or ban,
- establish provisions for epidemiological segregation,
- establish provisions for the delivery of shipments,
- establish provisions for the coordination of medical care of the protected driver and for the implementation and control of the medical standards applicable to the protected driver,
- may order epidemiological measures that may be taken by law,
- may make other provisions specified by law.
In Orbán’s absence, Pintér is the boss
The operational staff is led by the Minister of the Interior, Sándor Pintér, with the participation of Miklós Kásler, Minister of Human Resources. Viktor Orbán may attend the meeting at any time, in which case the meeting will be chaired by the Prime Minister.
Is another member of the operational staff
- the Secretary of State appointed by the Minister of Public Administration,
- Secretary of State appointed by the Minister of Economic Development,
- Secretary of State appointed by the Minister of Foreign Affairs,
- Secretary of State appointed by the Minister of Defense,
- Secretary of State appointed by the Minister of Health,
- the national medical director,
- Director General of Public Security of the Ministry headed by the Minister responsible for the application of the law,
- head of the guard center of the operational staff.
The operating body may also meet and make a decision or form an opinion by communicating its position or vote on the matter by electronic means. The work of the tribe is assisted by the Ministry of the Interior anyway.
Call center 0-24 hours
The on-call center for operational staff was created on February 25 to continuously monitor the morbidity data in Hungary and the epidemiological situation in European countries between panel meetings, and to verify the measures implemented. In addition, after collecting and evaluating the information, the service center can make recommendations to operational personnel for decision-making.
Police Colonel Tibor Lakatos has been appointed to lead the guard center, while his deputy is Lieutenant Colonel Róbert Kiss.
The operational staff met every day from March 5 to June 17 and also held a press conference the morning after the meeting. The emergency number at the emergency center received 18,765 calls and responded to 64,674 residential emails in those three and a half months.
Following the intensification of the second wave of the epidemic, as of September 19, the daily press conferences of the operational tribe were resumed. In them (at least most of the time) Cecília Müller, national chief physician, Lieutenant Colonel Róbert Kiss and Lieutenant Colonel Kristóf Gál, spokesperson for the National Police Headquarters, appeared in public.
