Forty years ago, Marianne Bachmeier shot the murder of her seven-year-old daughter in the courtroom of the crowded West German District Court (FRG) in Lübeck. Even the murder of a child has raised a lot of dust, and what the vengeful mother has done has become one of the best known and most debated legal and ethical issues of recent decades. Did he raise questions like how doomed is revenge and self-judgment?
Amazing story
Marianne Bachmeier raised Anna alone, who was seen as a happy and open-minded child. On May 5, 1980, he didn’t want to go to school, he wanted to visit his school friends, and he argued with his mother about this. But he could no longer face them. It is not known how he got to the home of Klaus Grabowski, 35, who lives nearby. On the other hand, it turned out that the man had held him for several hours before strangling him with a stocking. The prosecutor said the body was buried in a box on the bank of a nearby canal.
Klaus Grabowski was already known to investigators, having been convicted twice before of sexually abusing two girls. Like the sex offenders at that time, they were castrated in 1976 with hormonal treatment to prevent recidivism. Grabowski was arrested that night. He admitted to the murder, but denied abusing the boy. Instead, she told a strange and confusing story about the girl who tried to seduce and extort her by telling her mother that she had sexually abused her if she did not give her money.
On March 6, 1981, the third day of Grabowski’s trial, Marianne Bachmeier pulled a Beretta pistol from her purse and fired eight times at the defendant, who died immediately.
The unprecedented case sparked huge media coverage and completely divided the public. Many understood the motive, but condemned the act.
Did you plan it or not?
After shooting Grabowski in the back, Judge Guenther Kroeger heard the grieving mother say: “I wanted to kill him. I hope he’s dead. ”
Now, at her own trial, the mother testified that she had shot Grabowski in her dream and her daughter’s ghost appeared in the courtroom. “I heard you wanted to make a statement.”Bachmeier said later, referring to Grabowski’s allegations that his seven-year-old son was trying to blackmail him. He thought the next lie about his daughter would come now, and he couldn’t take it anymore. When asked for a handwriting sample after what happened, he wrote: “I did it for you, Anna.”
After a 28-day trial, the court sentenced Bachmeyer to six years in prison for intentional manslaughter.
Homicide, murder, self-trial
Murder It is considered in criminal law if someone, in some way, causes the death of another. “Either way” is an essential clause, as the law does not specify how the perpetrator causes the death of the victim.
TO murder term is no longer included in Hungarian criminal law. In previous laws, however, yes, and it meant premeditated murder.
Every year there are around 100 (pre-planned) intentional homicides in Hungary. Especially between close relatives. Which may seem surprising at first, but it is already more understandable that, for the most part, close emotions tend to develop emotional tension that can lead to the murder of the other.
the self determination (vigilantism) is a violation of the law with the intention of punishing a sin that the self-judge says the law does not punish or does not punish adequately.
Self-judgment is the same age as history, it has an ideology and a cultural memory that still works today. Heroes who judge themselves also appear in the folklore of many peoples and in today’s literature and cinema: barricades, outlaws, Robin Hood, Sobri Jóska. Or simply in the 1996 film If You Have to Kill, where an enraged protagonist (Samuel L. Jackson) shoots two men in court who raped his ten-year-old daughter.
According to a survey by the Allensbach Institute, more than half of Germans thought the punishment was appropriate or too severe.
He was released three years later. And she sold her story to Stern magazine to cover legal costs for $ 158,000, and the weekly delved into the story of the woman’s life.
A series of articles about her revealed that she was raped shortly before the birth of her second child and adopted her two children. Their third daughter, Anna, was born in 1973 and raised alone. And after Anna’s birth, Marianne Bachmeier was sterilized.
After his release, he married and moved to Nigeria. After divorcing her husband in the early 1990s, she moved to Sicily. There she was diagnosed with pancreatic cancer, so she returned to Germany, which was now united.
Betrayed him before he died
Das Erste, a Fliege television show, published on September 21, 1995, admitted that he did not shoot his daughter’s alleged killer for a sudden upset, but after careful consideration, to do justice and enforce the law. And also to prevent the spread of more lies about Anna. That he was prepared for the confrontation was also confirmed in a documentary about him by one of his friends who witnessed Bachmeier practice shooting a target in the basement of his pub. The fact that there was no death penalty in West Germany (FRG) may also have contributed to their decision, and the country was one of the first in the world to enshrine the abolition of the death penalty in its constitution in 1949.
Until his death, the media attention to him did not cease. Especially since he asked a journalist from the NDR (Norddeutscher Rundfunk German Public Service Medium) to film his last weeks. He died on September 17, 1996, at the age of 46. He was buried next to his daughter Anna.
To what extent does the vengeful mother condemn her act?
