The attack came at the last minute
On Monday, the electorate will elect the next president of the United States, who, according to the current position, will be the Democratic presidential candidate Joe Biden, who obtained 306 electoral votes against Donald Trump, which reached just 232. Just a week before the vote Republican attorney general of Texas, Ken Paxton, has decided to stand up to Donald Trump, who already shouted fraud before the elections and goes to the Supreme Court. On Tuesday, Paxton filed a lawsuit in which
asks the attorney general to prevent judges in Georgia, Michigan, Pennsylvania and Wisconsin from voting against it, as he considers that the elections in these states were decided by systemic fraud.
Along with the demand Attorneys general from 17 other US states also joined.These are all the states Donald Trump won in and traditionally have a Republican voter base. Missouri, Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Montana, Nebraska, South Dakota, Oklahoma, South Carolina, North Dakota, Tennessee, Utah, and West Virginia have chosen to support Paxton’s initiative.
In addition to state attorneys general 106 Republican members of Congress also voiced support for the lawsuit.
Unsurprisingly, Donald Trump also supports the initiative, writing on Twitter that
we will intervene in the case of Texas (and other states). That’s a big problem. Our country needs a victory!
It is not yet clear how Trump plans to back the initiative.
Can you translate Trump?
Most political analysts don’t think it’s realistic that Donald Trump and his supporters can translate in the Supreme Court.
Critics primarily argue that the Texas Attorney General does not have the power to speak in elections outside of Texas and that the lawsuit is political in nature, with the entire case not even reaching the Supreme Court.
Of course, many also complain that neither Paxton nor Donald Trump have so far been able to provide substantive evidence, which justifies the existence of a volume of electoral fraud that “played” the presidential chair to Joe Biden.
So far, Donald Trump has mostly only been able to produce anecdotal evidence:
Michigan Attorney General Dana Nessel wrote on Twitter that both Republican and Democratic prosecutors had already investigated the state elections and found that all was well, Paxton’s campaign was just a political maneuver.
Pennsylvania’s response was that Paxton’s initiative was an abuse of the judiciary and a response must be submitted to “ensure that such abuse does not happen again.”
In both Wisconsin and Georgia, the response was that it is not Texas that will decide whether the elections will be held in their states, so the lawsuit is pointless.
The Supreme Court has not yet dismissed the lawsuit, is currently being examined whether the Texas Attorney General had any right to go directly to the Supreme Court, bypassing the lower courts, which traditionally decide only if a consensus cannot be reached in another court.
In order for the Supreme Court to begin hearing the case, a minimum of five justices must decide that they want to take up the action.
If the judges decide to hear the lawsuit, the chances of destroying the election results of four states in a historic step remain low, as Paxton has been unable to provide substantial evidence in support of the lawsuit, based primarily on statistical analysis.
One of Paxton’s main arguments is that, according to economist Charles Cicchetti, 1 to a trillion was the statistical probability that Biden could win at the same time in all four states named in the lawsuit. That’s probably not enough for the Supreme Court to decide to destroy the voting results of 10 million people.
If they even decide to do so, which is almost unlikely, it is worth noting that
If Ken Paxton’s unprecedented initiative were successful, Joe Biden would be left out of 62 electoral votes and continue to win by 242-232 electoral votes.
It is not known what would happen if neither candidate had the 270 electoral votes that would be necessary to win. American political analysts do not address this possibility in detail, everyone considers the Paxton initiative highly unlikely to succeed.
Is everything going to presidential grace?
Several of the political commentators who saw the events believe that the whole thing is really going to
- Paxton must receive political and media attention to advance his own career,
- receive the presidential grace of Donald Trump.
The latter is a particularly interesting factor: Multiple lawsuits are pending against Attorney General Ken Paxton. The most serious of these is an FBI investigation launched after several high-level advisers accused the prosecutor of corruption.
Paxton is accused of accepting money from real estate investor Nate Paul in exchange for obstructing official investigations against him, and after it failed, he also fired seven people to remove the evidence.
Nate Paul donated $ 25,000 to Paxton in the form of a political donation and also donated to two other Texas Republican campaigns.
It’s worth noting, however, that while the seven fired employees denounced Paxton four months ago, the FBI began investigating the prosecutor only two days after he filed his lawsuit against the four states in the Supreme Court.
Also, there has been a lawsuit against Paxton since 2015, for recruiting investors for a startup called Servergy, for which he suspected he was taking a commission and did not reveal it. In this case, the process with the Attorney General in focus is pending for securities fraud.
He even hung around his neck an ethics investigation four years after accepting $ 100,000 from James Webb, a pharmaceutical investor who is being investigated for fraud.
If Donald Trump, who has already set his sights on Paxton, grants the prosecutor a presidential pardon, he may be exempted from all federal procedures. (Thus, for example, it would certainly be exempt from FBI investigations), but it would not be exempt from the burden of state procedures.
