The simplified procedure does not grant an exemption only if the procedure is simplified, the fulfillment of the conditions specified in the law for the exercise of the notified activity is not fulfilled.
Among other things, the authorities can prohibit the termination of an activity if it can endanger health, safety or the environment, provoke it and if the notification can lead to a tacit or repetitive practice. In the case of a prohibited activity within the territory, the authority, in accordance with current regulations, will carry out the authorization procedure in its entirety. A new type of audited report not only imposes a lesser administrative burden on companies and individuals, they also have to pay only ten fees if the licensing procedure is not necessary.
The regulation does not cover those cases in which, on the basis of international or unified regulation, the licensing procedure is absolutely necessary, for example, the acquisition and possession of a firearm must require the procedure to be carried out. The Regulation also does not apply to persons with a certificate, identity document or registration, as well as those for whom the authority must consider the availability of a benefit in cash or in kind. The regulation also lists other groups of vehicles that may still require authorization, such as medical and child protection procedures, technical vehicle examinations, naturalization and origin controls, or activities related to the handling of hazardous waste.
There are almost 25 million licensing procedures in 3-4000 different procedures by government agencies and other administrations. The current regulation is in line with previous measures to reduce intermediation, which have led the government to reduce the number of procedures, eliminate or increase fees, and shorten the time for repair.
