The competition supervision procedure of the Hungarian Competition Authority (GVH) concluded on December 21, 2020 established that the company’s “Test with us” and “Try” 2020 campaigns for the launch of DIGI Mobil services, implemented in 2019, constituted unfair business practices. The investigation revealed that although the company was promotional (including billboards and televisions) emphasized the possibility of unlimited mobile internet, while the contracts included the possibility of restricting or slowing down the service’s traffic.

It was also misleading that some of the campaign ads suggested that the new service was available to anyone. However, the construction was really accessible only to consumers who lived in the coverage area, who already had a DIGI / INVITEL subscription, that is, a narrower circle in general.

The telecommunications company’s campaigns also infringed in the initial period that in the absence of proper partnership agreements, roaming was not yet available under the service. This is an essential feature of a mobile service that can influence consumer choice.

The competition authority imposed a fine of HUF 45 million for the infringement.
