Hungary and Poland will establish a joint institute for comparative law to work together against “liberal ideological repression,” Péter Szijjártó announced on Monday after receiving his Polish counterpart, Zbigniew Raut.

The foreign and foreign ministers say the two countries are under heavy attack because their policies are “indigestible to the international liberal current.” According to Szijjártó, the common law institute “will accumulate sufficient legal security, basis and knowledge in the face of liberal ideological repression.” The minister stressed that Poland and Hungary reject the new migration pact of the European Commission, as he believes that it is pro-immigration and believes that the mandatory resettlement quota is still included.

According to Zbigniew Rau, the committee’s new migration pact also deprives host countries and migrants of choice, and says the plan needs deeper reflection and debate. Zbigniew Rau stressed that the institute aims to separate the political and legal arguments.

On September 23, Ursula von der Leyen announced a new migration pact that obliges member states to participate in the European Commission’s asylum system. One of the most important elements of the agreement is that if a Member State needs help, other countries can choose between receiving refugees from them or helping them repatriate. Under the pact, it will not be possible to wait months at the external borders and visitors will have to undergo a full screening in five days.

We have failed a lawsuit before

In September 2015, the EU’s interior ministers adopted a mandatory quota system, according to which Hungary should have temporarily accommodated 1,294 people. Hungary and Slovakia, among others, protested against the decision and filed a lawsuit because, in their view, the European Council made its decision in 2015 inappropriately, but the Court of Justice of the European Union did not consider this to be justified.

Hungary failed the second quota claim in April this year. In June 2017, the European Commission launched an infringement procedure against Hungary, the Czech Republic and Poland for failing to implement the decision to establish a mechanism to relocate tens of thousands of asylum seekers to Greece and Italy. In its ruling, the European Commission confirmed the action of the European Commission and found that Member States had failed to fulfill their obligations to the EU.
