The Hungarian Competition Authority (GVH) found that DIGI launched its mobile phone service on the market with a campaign that misleads consumers as, among other things, it made an unlimited promise of unlimited mobile internet, the authority writes.

The GVH competition monitoring procedure concluded on December 21, 2020 established that the “Try us” campaign launched by Digi Távközlési és Szolgáltató Kft., Launched in 2019, and the “Try it” campaign in 2020 implemented commercial practices disloyal.

The investigation revealed that although the company’s promotional advertisements (including billboards and television spots) emphasized the possibility of unlimited mobile Internet, the contracts included the ability to restrict or slow down the service’s traffic.

It was also misleading that some of the campaign ads suggested that the new service was available to anyone. However, the scheme was only available to consumers who live in the coverage area and already have a subscription to Digi or Invitel, that is, a narrower circle in general.

The telecommunications company’s campaigns also infringed in the initial period that in the absence of proper partnership agreements, roaming was not yet available under the service. This is an essential feature of a mobile service that can influence consumer decisions, writes GVH.

The competition authority imposed a fine of HUF 45 million for the infringement. When imposing the fine, the Office also took into account the fact that even before the competition monitoring procedure, the company corrected the fraud itself, expanding its services (making roaming available and abolishing the restriction of traffic from data).

GVH announced yesterday that it had initiated a lawsuit against Digi because promoting its high-speed internet service could mislead consumers.

In addition, Digit has been excluded from the sale of 5G frequencies by the National Media and Communications Authority.
