The Metropolitan General Court, which acts in second instance in the case of coercive measures, revoked the order of first instance of the Central District Plague Court (PKKB) and ordered the criminal supervision of the first defendant in the accident of Doczsa György út until the court of last instance decided.

According to one of the facts of the main proceedings, in 2017 Mr. Richárd collided with a high-performance car with western registration at the Doczsa György út in Budapest at a speed of about 140 kilometers with a car turning irregularly, two passengers were killed, his driver was fatally injured and me. The other driver was also charged in the case. According to another indictment, there was a traffic incident between Richard Richard and a cyclist in 2015, for which the prosecution charged Mr. Richard with harassment, minor bodily injury and danger on the road.

Richard M. admitted to harassment and minor bodily harm, and partially admitted responsibility for the fatal car accident.

On September 30, the Central District Plague Court, sentenced in the first instance, sentenced Mr. Richárd to 4 years in prison and 4 years of disqualification from public activity, and definitively disqualified Richárd from driving for causing a traffic accident. , harassment as co-perpetrator and assault. The court then ordered a separate order to end the criminal supervision of the accused. The prosecution appealed the sentence for aggravation and, in the case of coercive measures, appealed the arrest of the accused, citing risk of flight, hiding and recidivism.

The Metropolitan General Court, which acts in the second instance in the case of coercive measures, revoked the PKKB’s first instance order and ordered the criminal supervision of the defendant in the first degree in the criminal case initiated on the accident of Dozsa György út until the court of second instance rules. According to this, M. Richárd cannot leave the administrative area of ​​the Budapest and Pest counties without a separate permit and is obliged to report to the designated police station twice a week.

According to the Metropolitan Court, the court of first instance correctly considered that there was no risk of flight or hiding from M. Richard, since the defendant did not appear outside the scope of the criminal process during the investigation and the judicial process. In addition, according to established judicial practice, the order or maintenance of a detention can be justified with a custodial sentence of more than 5 years, so that the amount of 4 years in prison imposed on the accused does not justify the most severe coercive measure, the arrest warrant.

However, the appeals court did not share the PKKB’s view that there was no risk of recidivism, as the defendant was suspected of having committed new offenses, including intentional bribery, during the investigation. Shortly after the first instance ruling, an infringement proceeding was started against him for driving without a license.

According to the court, the risk of recidivism can be established in the case of the accused, given his background, lifestyle repeatedly convicted and the fact that the severe punishment imposed on him did not dissuade him from committing another illegal act.

For all these reasons, the court held that coercive measures and criminal supervision are also justified at this stage of the process. The second instance order is final.

In 2006, M. Richard was sentenced to eight years in prison in the so-called Kecskemét mafia trial for being a “soldier” of a criminal organization run by László Radnai, accused in the first degree. The criminal organization was involved in drug trafficking, the taking of defense money and prostitution, and when some of its members were arrested in 2004, they were about to settle scores with a rival gang.
