Parliament approved the ninth amendment to the Basic Law by 134 votes to 45 and 5 abstentions, on Tuesday morning, which enshrines in the constitution that the mother is a woman, the father a man and public money is income, state spending and demand. As a result of the final vote, 15 deputies did not vote.
Before the final vote, the representatives of the Democratic Coalition withdrew from the Chamber.
The bill on the ninth amendment to the Basic Law was presented by Justice Minister Judit Varga on November 10. According to the government, this will include, among other things, greater protection of Hungarian families and the safety of children in the constitution.
According to Judit Varga, in article L) the following provision is inserted, which reinforces the concept of family:
Hungary protects the institution of marriage as a cohesive life between a man and a woman, as well as the family as the basis for the survival of the nation. The basis of the family relationship is marriage and the relationship between parents and children. The mother is a woman, the father is a man. “
Article XVI on the right of the child to physical, mental and moral development. The following is added to Article 1:
Every child has the right to the protection and care necessary for their physical, mental and moral development. Hungary protects children’s right to self-identity according to their birth gender and provides education in accordance with values based on Hungarian constitutional identity and Christian culture.
Article 38 of the Basic Law is complemented by the fact that “the establishment, operation and extinction of a public trust fund that performs a public function and the performance of its public function are regulated by a cardinal law”.
THIS MEANS THAT ONLY A MAJORITY OF TWO THIRD PARTIES CAN CONTRIBUTE TO A FOUNDATION FORM, SUCH AS BUDAPEST CORVINUS UNIVERSITY AND FILM THEATER AND ART.
The justification for the amendment establishes that “the new constitutional provision strengthens the independence of public interest trusts that carry out public functions of the current government by linking their most basic rules to a cardinal law.”
The following is added to article 39 of the Basic Law that a
Public money is the income, expenditure and right of the state.
According to the detailed explanatory memorandum, the concept of public money is defined in order to “develop a uniform practice rather than a different one in the practice of constitutional bodies”. The document also says that the concept of public money, which is a guarantee of transparent use of public money, is defined “clearly, clearly and completely as a whole.” It is also justified that “by definition, the term encompasses all constitutional, state, and local government bodies, as well as state and local government institutions.”
“The special legal order is a state of war, a state of emergency and a state of emergency”: the amendment replaces and consolidates in these three concepts the six special legal orders of state of emergency, state of emergency, preventive defense, emergency, terrorist threat. and the unexpected attack. According to the explanatory memorandum, the amendment “aims to create a more modern and efficient system that is better suited to the changing security environment and builds on the crisis management experience of recent years.” In addition, “it incorporates, in a series of points, additional guarantees regarding the organizational, operational and regulatory framework for the provision of defense and security functions.”
