Can vaccination against Covid-19 be made mandatory in some jobs, or must the employer provide it to its employees, or can it be sanctioned if the employee is not vaccinated? – asks the question from hrportal.hu

The professional part recalls that the detailed regulations on vaccination in the workplace are contained in the Ministerial Decree (Decree 18/1998 (VI. 3.) NM) on the spread of infectious diseases and, therefore, on mandatory vaccinations and recommended.

Hazards must be assessed

With regard to work-related vaccines, the regulation establishes that the employer is obliged to adequately assess occupational health risks that endanger the health and safety of workers and to provide vaccination to workers at risk to reduce these dangers.

It is also stated that in certain health jobs, the employer is required to offer influenza vaccination.

In addition to the decree, the National Center for Public Health issues an annual vaccination methodology letter that specifies in which jobs which vaccines are mandatory.

It is important to note that since the 2020 letter did not yet include guidelines for these vaccines, this year it has yet to be issued.

In summary, at present, in the absence of sufficient information, the methodological letter cannot even make recommendations for vaccinations against Covid-19.

In this case, it may be mandatory

Under current regulations, an employer can make vaccination mandatory for employees if required by law. However, as there are no specific guidelines for coronavirus yet, employers currently cannot make vaccinations mandatory except when working in healthcare jobs where patients with weakened immune systems are involved or where healthcare workers they are highly exposed.
