The European Commission considers that the conditionality mechanism adopted in the context of the EU budget and recovery fund is in line with the agreement reached by the leaders of member states in July, it said. Mamer explained that in the opinion of the EU commission, the mechanism focuses on the protection of the European Union budget and has the means to ensure the fair and just application of the mechanism.

The Court of Justice of the European Union will have jurisdiction over any measure adopted under the budget protection regulation, he said.

According to him, the EU treaties also provide for a so-called Plan B in case the final adoption of the EU’s seven-year framework budget from 2021 fails. In the absence of an agreement on the multiannual financial framework, the contract will stipulate the continued validity of one twelfth of the prior year’s budget amount on a monthly basis. The EU committee is technically preparing for this possibility, he said.

However, the priority is, of course, to establish a seven-year framework budget and run a fund to repair the damage caused by the coronavirus epidemic as soon as possible, early next year, an EU spokesperson added.

In July, the European Council of EU leaders agreed on a budget of 1.8 billion euros for the next seven-year EU budget and a fund to repair the damage caused by the coronavirus epidemic.

However, the agreement was not approved by the European Parliament (EP). The panel has not funded several EU programs and envisages the introduction of a conditionality mechanism to examine the rule of law in the EU budget and recovery fund in order to protect EU funds.

In early November, the German Presidency of the Council of the European Union and European Parliament negotiators reached an interim agreement on the establishment of a new set of political conditions linked to the EU budget, including the need to comply with the status of right. The set of political conditionalities could be part of the next framework budget, as well as the recovery package.

However, the agreement on the budget and the recovery package, which requires unanimity, was not decided at a meeting of the EU Permanent Representatives to the European Union in mid-November due to the veto of two EU member states, Hungary and Poland.
