The rules of teleworking have changed for the duration of the emergency.

According to a government decree published in the Hungarian Gazette in the evening, the new rules for telework announced for the duration of the emergency are valid as of Thursday. The regulation regulates three things.

In the case of teleworking during an emergency, your teleworking health and safety passport does not apply. On the other hand, the employer must inform the employee about the rules of safe, secure and safe working conditions for work, and the employee must choose the workplace in such a way that these working conditions are met.

During the emergency, the amount paid as compensation for telework in connection with telework may be counted as an expense without proof. Up to 10 percent of the monthly minimum wage (HUF 16,100) can be charged per month. If the work is less than a month, it is proportionally less. It is also a condition that the parties (employer and employee) agree to reimbursement in advance and that the individual does not account for the costs mentioned in the PIT law in relation to teleworking (for example, Internet use related to teleworking, rent by place of work).

In addition, during an emergency, the employer and the employee may agree to deviate from some of the rules on telework established in the Labor Code. One of those rules is that it must be agreed in an employment contract that the employee will be employed in teleworking. If we understand correctly, they say that teleworking still has to be agreed during the emergency, but this should not be included in the employment contract. This can make the transition to work from home a little easier. It is also possible to repeal the rule that teleworking should be a regular activity and the various information obligations of the employer.
