On Tuesday, the draft law on the ninth amendment to Hungary’s Basic Law, registered by Justice Minister Judit Varga, was posted on the parliament’s website.
The Ninth Amendment would immediately rewrite the first paragraph of the Basic Law, as it would include “the mother is a woman, the father is a man.” According to the general reasoning, it is necessary because “The Basic Law of Hungary is a living framework that expresses the will of the nation, the way we want to live. However, the set of “modern” ideas that makes all traditional values, including the creation of the two sexes (a woman and a man) relative, is a growing concern ”.
Furthermore, the Basic Law would stipulate that “the establishment, operation, termination and operation of the public interest trust foundation is governed by a fundamental law”, that is, the Basic Law would stipulate that only two foundations the parliament can do anything.
According to the justification presented, this reinforces the independence of the public interest trusts with respect to the current government, but it can also be read that after a possible change of government, once very serious state assets could remain in the hands of the NER.
The best-known example of such a foundation is the Mathias Corvinus Collegium Foundation, which received not only astonishing assets, 10-10 percent of the shares of Mol and Richter, but also a very serious real estate portfolio. An increasing number of universities operate with a similar structure, with several actors close to the NER appearing in their directories.
Judit Varga would also enshrine the concept of public money in the Basic Law, since in her opinion its use has not been uniform until now in the practice of constitutional bodies. According to this, the Basic Law would affirm that “public money is the income, expenditure and demand of the State”, but it is about how its declaration would affect the management of state-owned companies or, let’s say, central bank foundations, where Attempts have already been made to lose public money. But in the same way, there has been a debate on whether TAO money is considered public money, this will no longer be a contentious issue after the constitutional amendment.
The amendment would also transform special cases of a legal order: instead of the previous six types, it would now only recognize three cases, such as the state of war, the state of emergency and the emergency.
