On Thursday the trial for the fatal traffic accident of Doczsa György út continued in the Central District Plague Court with the presentation of documents and dialogues. The Dozsa György út tragedy took place in May 2017. Richard M. crashed his Mercedes into a left-handed Citroën at tremendous speed. The car that was trying to turn turned several times due to the collision and then flew towards the bus stop. Two people died in the accident. Although Richard M. used drugs, experts said it did not affect his ability to drive.

According to the indictment, Richard Richárd drove in Dōzsa György út towards Kassák Lajos utca at a speed of 135-140 km / h significantly exceeding the 50 km / h allowed without a driver’s license. That’s when the 47-year-old arrived at the crossing N. József, who made an uneven curve in a small curve in front of the driver arriving at high speed without giving priority. The two wagons collided with such force that both vehicles rolled onto the sidewalk and struck three pedestrians. In the collision, one of the occupants of the curved vehicle fell from the car with such force that he was killed on the spot as a result of his injuries. The other passenger died in the hospital and three pedestrians were more easily injured. The driver of the car turning a curve was in mortal danger, while Richard M. suffered minor injuries.

For this process, the case of Richard was joined, in which his license had previously been revoked. According to the indictment, Richard M. nearly dragged a bicyclist, then during the resulting conflict, he got out of the car with his passenger and struck the bicyclist.

The current trial began with the presentation of opinions of previous forensic experts. The defense objected to the findings of the psychiatric examinations and made more motions, but the judge rejected them. The prosecutor spoke for the first time in his indictment about the attack on the cyclist. As he said, it is quite clear that the defendants wanted to throw the man off his bicycle and abused him by hitting his car.

He emphasized that it was also clear that Richard had been driving fast at the time of the accident, as evidenced by the technical expertise, as well as the recording of the defendant being videotaped before the impact. The prosecutor also discussed in detail the responsibility of the other defendant in the accident, József N. In his opinion, the man practically put himself in a difficult position when cutting the curve. If you had turned a large curve, you could have seen the other car speeding up and avoided the accident.

In his conversation, the prosecutor also referred to the findings examining the mood of MM Richard. Like you said, just because someone has a personality disorder doesn’t mean it can’t be counted. At the end of his trial, the prosecutor asked Mr. Richard for a prison sentence for negligence that caused a fatal traffic accident and other crimes, with a permanent ban on driving.

He cited as aggravating the man’s criminal record and the fact that he was driving under a driving disqualification. At the same time, he evaluated Richard M.’s partial confession and the passage of time as extenuating circumstances. Józsefre N. requested probationary imprisonment for the negligent cause of a fatal traffic accident.

It is worth noting here that even at the beginning of the trial, the prosecution asked Mr. Richard for 7 years and 2 months in case he pleaded guilty at the preparatory hearing and also waived his right to a trial. As the crime committed by M. Richard is punishable by 1 to 7.5 years in prison, this means that the prosecution would settle for a sentence significantly different from the average of 4 years and 3 months.

In his defense, Richard M.’s defense attorney complained that the opinions and conclusions requested had not been taken into account. It covered childhood with the protégé’s vomiting, his previous illnesses, the responsibilities of the other driver, and the fact that the student boy’s seat belt in the other car was not fastened at the time of the accident. And the NN defender explained that the other vehicle came at such speed that his protégé had no opportunity to assess the situation.

In the last word, Richard said that he never intended to absolve himself of liability. He recognized that he was driving fast and regretted what happened.

He said, later regretting that he had not apologized to the victims’ families earlier.
