The Metropolitan Court dismissed the appeal of 13 Iranian students who had been expelled from the country by the National Directorate of Immigration on March 16.
The OIF made that decision at the suggestion of the police, as they launched an investigation into the students for violating epidemiological regulations. The 13 Iranian students were quarantined at St. Ladislaus Hospital on March 7 because they came into contact with a person who had been diagnosed with a coronavirus infection.
With the ruling of the Metropolitan Court, the expulsion was made enforceable.
According to its statement on Thursday, the court rejected the appeal of Iranian students because the law required the immigration authority to consider the police expulsion proposal, the authority “could not deviate from that.”
According to the court, it is also not prohibited to return to students. According to them, this would be the case if the affected people, such as patients with a fatal or serious illness, “did not receive adequate medical care in the country of return.”
This is not the case, as “Iranian students, even if infected, are unlikely to need to alleviate suffering that cannot be achieved in their home country,” the court argued.
One of the interested parties, a 33-year-old Iranian student, was legally represented by the Hungarian Helsinki Committee. The organization commented on the court’s decision regarding its client on Wednesday, according to a report by Magyar Orange: “It is an unprecedented move to break a girl’s life in two as a result of a series of clearly composed measures.”
However, the Helsinki Commission appealed to the European Court of Human Rights in Strasbourg in the girl’s case, hoping that the court will order the suspension of deportation for a so-called provisional measure. András Kristóf Kádár, co-president of Helsinki, said that all legal possibilities would be used, that the procedures would be carried out, even if the girl was no longer in Hungary.
