Wenchi High Court, chaired by Judge Fredrick Arnold Nawurah, overturned a restraining order filed by the Democratic National Congress (NDC) against the inauguration of Martin Adjei-Mensah Korsah, as Member of Parliament (MP) for the district Techiman South election.
The Party filed the precautionary measure praying to the court to stop the inauguration of the elected deputy and questioned the validity and result of the results of the parliamentary elections in the circumscription.
The petitioners accused the EC of manipulating the results compilation in favor of the elected deputy and believed that their candidate, Mr. Christopher Baasongti Bayere, won the parliamentary seat in the recently concluded general elections.
But, in court session on Tuesday, Judge Nawurah indicated that the petitioners had no case, saying that the document presented by the NDC was inconsistent and without foundation.
Later, Mr. Kwabena Asare, a lawyer for the elected deputy, told the Ghana News Agency (GNA) that his client did not receive any court notification.
Post-election violence erupted in Techiman municipality, leaving two dead, while four others who were perceived as NDC supporters suffered gunshot wounds.
The incident occurred at around 3.30 pm in the Techiman Bonokyempem hall on Tuesday, December 7, when Sampson Ofori Gyamfi, Techiman’s municipal election official, declared Korsah the winner of the parliamentary elections.
According to the EC, Mr. Korsah obtained 49,682 votes to beat his enthusiastic contender, Mr. Beyere, who had 49,205 votes.
The total of votes cast for the parliamentary elections was 99,828, the total of valid votes 98,887 and there were 941 rejected votes.
Not satisfied with the results and the EC’s statement, some aggrieved NDC supporters tried to break into the Bonokyempem room where the results collection was taking place, but were not allowed to do so by security agents.
The situation led to further misunderstanding between security officers and NDC supporters, and in the cause of the riot, security personnel fired shots to disperse the crowd.
Two people were reported to have died in the incident.
