Was Kennedy Agyapong’s medical excuse duty calculated to delay court? – the judge asks the doctor

One doctor, Kennedy Kwabena Addo, who is said to be treating Assin Central MP Kennedy Ohene Agyapong, has insisted that he issued a 14-day duty of excuse for the MP after assessing his condition.

This was in response to a question posed by Trial Judge Amos Wuntah Wuni who required the doctor to comment on his view that the duty to excuse is intended to delay the hearing.

The legislator was supposed to appear in court and defend the comments he made that the court considers to constitute contempt on Monday, September 28.

This was after the court suspended the proceedings on Friday, September 25.

But Agyapong’s lawyers appeared in court with an excuse of duty that exempted Agyapong from the activities for 14 days. Subsequently, Dr. Addo was ordered to appear and explain the duty of excuse.

In testimony that lasted more than 60 minutes, Dr. Addo said that the MP’s condition was unusual.

According to him, this was due to a medication that he put on the MP for 14 days. He told the court that this is what explains the duty of excuse.

Dr. Addo’s testimony began on a controversial note when his attorney, C. A Chambers, and Mr. Agyapong’s attorney, Alexander Afenyo Markin pressed for the courtroom to be cleared.

The lawyers insisted that the doctor explaining the duty of excuse will lead him to violate the confidentiality requirement of the patient client.

Mr. Markin explained that the physician who testifies with the media present will put the legislator’s medical records in the public domain.

Judge Wuni rejected the request, assuring that the parliamentarians’ medical records will not be discussed.

The judge raises problems with the document

Judge Wuni later raised issues with the document signed by the Doctor.

First was the fact that the document did not have an Outpatient Department Number, in addition to noting that the MP’s age is not indicated on the document even though it provides for it.

Dr. Addo first explained that he issued the note “on an outpatient basis.”

This, he said, was after he had detained the MP on September 25 and released him on September 26. Regarding the age of the MP, the doctor said that she chose to write “Adult” so that no one who sees the document will notice her age.

Judge Wuni pointed out that the deputy is a public figure whose age is known.

Judge Wuni said he was surprised that the age was not written even though the form required it to be written.

Dr. Addo agreed with the judge.

Dr. Addo further stated that he gave the MP 14 days without review because it was necessary.

Postponing the case, Judge Wuni said: “As professionals, as far as possible, in the interest of this beloved country of ours, we must do the right and ethical thing to take this country to higher heights.”
