A prosecution witness has told the Accra High Court that the voice in a leaked tape inciting violence against some prominent people was that of the national president of the National Democratic Congress (NDC), Samuel Ofosu Ampofo.

In his testimony yesterday, the investigator, Chief Inspector Bernard Bekoe, said that the voice from the leaked tape and that from another recording of Mr. Ofosu Ampofo were sent for forensic analysis, and the results showed that the voices in the two recordings were the same.

That recording, compared to the leaked tape, he said, was a recording of Mr. Ofosu Ampofo addressing supporters of the National Democratic Congress (NDC) at the headquarters of the Ghana Police Service’s Criminal Investigations Department after he was invited. to help with investigations.

“According to the experts’ report, there is a 90 percent probability that the voice of the first defendant, Mr. Ofosu Ampofo, is the same in both recordings. This, therefore, means that the voice in both audio recordings is that of the first accused (Mr. Ofosu Ampofo).

“There is also an 85 percent chance of matching features and speech defects. They explained to me that certain words such as ‘people’, ‘officer’, ‘police’ were also pronounced the same in the two recordings, “he added.

According to Chief Inspector Bekoe, the forensic analysis was carried out by the Israel Institute of Forensic Sciences.

Not guilty

Mr. Ofosu Ampofo and Mr. Kwaku Boahen, an NDC Deputy Communications Officer, are on trial for a leaked tape in which a voice believed to be Mr. Ofosu Ampofo was heard inciting supporters of the NDC to perpetrate acts of violence against the leaders of the Electoral Commission (EC) and the National Peace Council (NPC).

The two have pleaded not guilty to conspiracy to commit assault on a public official, while Ofosu-Ampofo has separately pleaded not guilty to two counts of assault against a public official.

Attorneys for the NDC national president have argued that the alleged leaked tape, said to contain his client’s voice, was manipulated, while Boahen also presented an alibi, arguing that he was not even at the meeting on February 3. of 2019, where Ofosu – Ampofo is said to have made the alleged inciting comments.

Alibi

On Boahen’s alibi, Chief Inspector Bekoe said his investigations showed that although some people, including Boahen’s mother, told police that he (Boahen) was in Bomfa Achiase on February 3, 2019, other investigations showed otherwise.

For example, he said, Boahen, by claiming an alibi, said that (Mr. Boahen) slept in a hotel known as the Marigold Hotel on February 3, 2019, but investigations showed that was not the case.

“The hotel manager told me that on February 3, 2019, he was on call all day and that the second defendant never showed up there,” he said.

The trial will continue on January 11, 2021, before the court, presided over by Judge Samuel Asiedu, judge of the Court of Appeals, acting as judge of the Superior Court.

Facts of the accusation

According to the prosecution’s facts, after the Ayawaso West Wuogon by-elections characterized by violence on January 31, 2019, Mr. Ofosu Ampofo met with some NDC communicators on February 3, 2019.

The facts explained that at said meeting, Mr. Ofosu Ampofo and Mr. Boahen established a roadmap of criminal activities, including violence against the President of the EC, Ms. Jean Mensa, and the President of the APN, the Most Reverend Professor Emmanuel Asante.

He said an audio recording of the meeting was leaked, leading to investigations by the Criminal Investigations Department of the Ghana Police Service into the comments on the tape.

The prosecution added that on February 20, 2019, Mr. Boahen granted a radio interview in which he confirmed his participation in the meeting, and also revealed that the leaked audio recording was a true reflection of what happened at the February 3 meeting. of 2019..
