The Speaker of Parliament, Professor Aaron Mike Oquaye, speaking on a petition presented to the House by the New Patriotic Party, has declared vacant the seat of the Member of Parliament for Fomena, Andrew Amoako Asiamah.

The New Patriotic Party wrote to Parliament asking the chamber leadership to expel the deputy after he stood before the Electoral Commission to stand in the 2020 parliamentary elections as an independent candidate.

According to the Party, Andrew Amoako Asiamah lost his membership because of his action and that serves as a plausible reason for removing him from the House under article 97 (1) (g) of the 1992 Constitution.

“For the avoidance of doubt, Article 97 (1) (g) of the Constitution states that: A member of Parliament will vacate his seat in Parliament if he leaves the party of which he was a member at the time of his election to Parliament to join to another party or seek to remain in Parliament as an independent member, ”the PNP said in a statement.

The President on Saturday, November 7, 2020, when pronouncing on the petition, said that “having lost his membership in the party on whose ballot he was elected to parliament, the operational language of the constitution is that he must, that it is mandatory to vacate his seat in parliament. Following an intentional interpretation of current law, advisory actions by the MP are important. For all intents and purposes, he is no longer a member of the party, he has publicly declared himself independent and has presented his papers to compete against the party and its candidate as an independent candidate on December 7, 2020 ”.

“On that occasion this parliament will continue to function as the official parliament of the Republic of Ghana. We will not have a situation freely adopted by any sitting MP when he / she will campaign freely against the party that still represents in parliament and yet ridiculously opposes the party. No intentional interpretation of the law will allow such ridiculous to prevail, ”the speaker said.

According to the speaker, the loophole in such a ridiculous situation is not what was envisaged in the 1992 constitution.

He stated that: “given the circumstances, Parliament has determined that the conduct of H.E. Andrew Amoako Asiama is tantamount to vacating his seat in parliament. Consequently, we inform the Electoral Commission so that the necessary measures are taken in accordance with the law ”.
