The prosecution in the murder trial of former University of Ghana law professor Professor Emmanuel Yaw Benneh finally produced a full medical report on the second suspect, Opambour Agya Badu Nkansah.
This comes weeks after the prosecution failed to bring the suspect to court, the most recent being the prosecution’s failure to comply with the 48-hour deadline given by the court to provide him with the medical report.
Nkansah, who is facing court on conspiracy and murder charges, has been absent eight consecutive times since October 14, 2020 after the prosecution told the court that Nkansah was unwell and receiving treatment at the Police Hospital. .

At the Kaneshie district court on Tuesday, December 29, 2020, the presiding judge, Ms. Ama Adomako Kwakye, who acknowledged receipt of the medical report, indicated that all costs incurred by the state in Nkansah’s treatment could have been avoided.
Furthermore, he advised the police and investigators to deal with the detained defendants in a professional manner.
Postponement
The prosecutor, Inspector Ebenezer Teye-Okuffo, also prayed for a postponement, as Nkansah was still admitted to the hospital.
The presiding judge also asked the prosecutor about the preparations for the judicial process.
In his response, Inspector Teye-Okuffo said that the prosecution was waiting for Nkansah to be discharged from the hospital so that he could consolidate the charges and forward the file to the Attorney General’s Department for advice.
Nkansah’s attorney, Emmanuel Larbi, expressed concern about his client’s absence, as well as the medical report.
The court further ordered the lawyer to request copies of the medical report.
The case was postponed until January 25, 2021.
Another suspect
Meanwhile, the prosecution hopes that Nkansah will be released to consolidate his charge sheet and that of the third suspect, Ebenezer Kwayisi, alias Junior, who has been charged with murder and instigation of crime.
The main suspect, James Nana Womba, who according to police confessed to killing Professor Benneh, died on October 17, 2020 in police custody.
According to the police, he fell ill suddenly and was rushed to the Police Hospital, but died later.
