Produce a medical report of Professor Binneh’s second ‘killer’ in 48 hours: court orders police

The Kaneshie District Court has given police investigators a 48-hour ultimatum to provide them with a full medical report on the second suspect in the murder of Professor Emmanuel Yaw Benneh.

The second suspect, Opambour Agya Badu Nkansah, was absent from Thursday’s court session, which the police attributed to the fact that the defendant was still in treatment and that his medical report was not ready.

This is the fifth time that Nkansah has not appeared in court.

The prosecution, led by Inspector Ebenezer Teye-Okuffo, asked the court to grant them a short postponement to make the full medical report on Nkansah available and also to submit it to the court.

According to Inspector Teye-Okuffo, he would ensure that court orders were available to the investigator of the case.

The court chaired by Ms. Ama Adomako Kwakye did not take the prosecution’s request kindly, saying that the defendant’s life was important and should also be treated fairly.

According to the court, he will not accept excuses from the prosecution, adding that the head of the Criminal Investigations Department of the Ghana Police Service should come to court to explain the problems.

The court further read the orders it gave on November 9 and 18 this year regarding Nkansah’s health, as well as his unfulfilled court appearance.

The trial was postponed until Monday, December 14.

Nkansah is on trial with James Nana Womba, the main suspect, who has now passed away. Nkansah and Womba are in custody on charges of conspiracy to commit a crime with murder. Nkansah’s request has not been accepted.

The facts of the prosecution are that Akosua Benneh, the elder sister of the deceased, is the complainant, while Womba is a domestic worker for the late Professor Benneh at his home in Adjiriganor, near East Legon, Accra.

The prosecution said that on September 13 this year, the body of the 66-year-old law professor was found in a pool of blood in a supine position with his hands and legs tied.

The Prosecutor’s Office said that the body of the deceased was deposited in the Morgue of the Police Hospital in Accra.

The prosecution said that on September 13 this year, investigations led to the arrest of Womba, who confessed to the crime and named Nkansah and others as his accomplices.

The prosecution said that on September 21 of this year, Dr. Owusu Afriyie, a pathologist at the Police Hospital, performed an autopsy, which revealed that the cause of death included strangulation and alleged homicide.

Police intelligence led to Nkansah’s arrest in Ashiaman, while an Ebenezer Quaysie, a third accomplice, was also detained.
