Telecommunications giant MTN Ghana says its concerns regarding the National Communications Authority (NCA) declaring it a Significant Market Power (SMP) remain unresolved.
MTN Ghana said it respects the High Court decision and has full confidence in the Ghanaian judiciary.
He added that after having had his day in court, the company “will refrain from making any further statements or comments on this matter at this time while we explore all available options and next steps in this process.”
On September 1, the High Court of Justice (Commercial Division) dismissed the company’s request for judicial review of MTN Ghana’s declaration as Significant Market Power (SMP).
The decision to declare MTN Ghana an SMP is in response to a directive from the Ministry of Communications to the NCA that seeks to address market disparities and revenue share in the telecommunications sector.
The Electronic Communications Act of 2008 (Law 775), which provides for the regulation of electronic communications, was to be applied by the NCA to guarantee fairness for all network operators in the industry.
Following the ruling, MTN Ghana said it recognizes the duty and powers of the National Communications Authority (NCA) to promote fair competition among licensed operators in Ghana’s telecommunications sector within relevant Ghanaian laws and best practices. acceptable in the global industry.
However, it indicated that it had challenged the NCA’s statement on procedural grounds, alleging that the Authority’s decision did not meet the requirements of procedural fairness.
MTN Ghana assured the government, its shareholders and clients of its unwavering commitment to delivering a bold new digital world in the country.
“The company remains focused on providing the enabling technology to support Ghana’s digital economy, especially during the Covid-19 pandemic,” he said.
