MTN Ghana’s Scancom Plc operators say they have dropped their case against the National Communications Authority (NCA) and declare it a Significant Market Power (SMP).
The telecoms giant says it is making commitments to the Authority in a concerted effort to resolve the administrative and procedural legal challenge related to its SMP statement.
In a press release signed by Samuel Koranteng, corporate services executive at MTN Ghana, he explained that based on “the progress made so far, in good faith, in discussions on agreements with the NCA and the Ministry of Communications,” he decided to withdraw Their case.
MTN Ghana had filed a case with the Supreme Court on September 4, after an Accra High Court dismissed a lawsuit it filed to prevent the NCA from declaring it SMP.
Previously, the telecommunications giant had filed a lawsuit requesting the court to review the Authority’s decision, which they say violates their right to due process.
But MTN Ghana says it has dropped the case.
“We expect that this action will pave the way for further discussions and a friendly resolution, in the spirit of renewed channels of participation,” the statement said.
According to MTN Ghana, it identifies that collective goodwill and commitment are necessary to help the entire industry prosper and support the government’s agenda to improve connectivity and the availability of communication services in the country.
“We are convinced that this decision is in the best interest of our dear customers, shareholders and other interested parties.
“MTN Ghana would like to assure its dear Customers and Shareholders that our commitment to delivering a bold new digital world in Ghana remains strong,” he added.
