Martin ABK Amidu, a former special counsel, has briefed Professor Henry Kwasi Prempeh, executive director of the Center for Democratic Development (CDD), on the latter’s comments about the Airbus scandal.
Henry Kwasi Prempeh, on November 14, stated that it was not for the Office of the Special Prosecutor (OSP) to decide whether or not former President John Mahama should be prosecuted for alleged corruption in the Airbus purchase agreement for Ghana.
According to Prempeh, if Martin Amidu, while in office, was faced with a dilemma over John Mahama’s political position, he had no power to stop the prosecution without seeking legal advice from the Attorney General.
Speaking on Joy FM’s Newsfile, Professor Kwasi Prempeh said: “I think this is a political call that the Special Prosecutor should not make. Even if it says that ‘I cannot proceed with the prosecution because my hands are legally tied’, perhaps it is bound by a certain constitutional provision. I think even in that situation, the best recourse would have been to get an opinion from the Attorney General. You could go to court and let the defendants raise that objection and say ‘look, I’m constitutionally immune’ and that goes to the Supreme Court for determination. “
He stated: “Or it’s a political trial because he’s a candidate, then you go to the Attorney General and say, ‘Look, I have this case. I have the facts according to the law to proceed, but given the nature of the holder of the position, can I proceed with that prosecution? And then the Attorney General could offer you an opinion. I don’t think it is within the scope of PASB on this particular matter for him to make the decision not to be able to proceed with the prosecution. ”
This Martin Amidu has responded in a 27-page response to President Nana Addo Dankwa Akufo-Addo’s nine-page response to the former’s resignation letter, giving more details of what his decision not to prosecute the former president reported.
Amidu stated in paragraph 34: “I heard and read Dr. Henry K. Prempeh, Executive Director of CDD Ghana, sell the same falsehoods that he has repeated in his paragraph 10 about Joy FM, which was reported on November 14, 2020 in line under the title: ‘Airbus scandal: Martin Amidu had no excuse not to prosecute Mahama.’ This was after she had seen him in the Presidency in the company of two other lawyers one business day before their engagement on Saturday 14 November 2020 on Joy FM, condemning my legitimate exercise of discretion as Special Counsel after taking all relevant matters into consideration … Henry K. Prempeh knows that I know he is a friend of the President, and I told him so in two meetings that the CDD He argued with me in my old office to use that influence to help the Office. ”
Amidu further stated that President Akufo-Addo instructed a Minister of State while he was on a campaign tour of the northern region to contact him to explore whether or not it was prudent to investigate former President Mahama after that the latter had recently won. your party’s presidential primary.
“The president was informed as president of the National Security Council about why the investigation had to be kept on hold until after the elections and he consented. I can prove this with mathematical precision if the president so wishes. “
