Renowned attorney Kwame Gyan, attorney for the Hon. Kennedy Agyapong in the contempt case brought against the MP, says the Judge, His Honor Judge Wuni, who was presiding over the matter, made it “personal.”
Supreme Court Wednesday [October 14, 2020] It partially ratified a request for prohibition and certiorari presented by lawyers for the MP.
The higher court upheld Judge Wuni’s order that Mr. Agyapong appear in High Court to answer for contempt, but prohibited him from presiding over the case and also annulled all the proceedings that had taken place before Judge Wuni.
“The matter must be returned to the Clerk of the Superior Court for the Clerk to present it to the Superior Court constituted differently,” the Supreme Court maintained.
According to the court, it will give the full reason for the decision on October 20 of this year.
The five-member court panel was chaired by Judge Paul Baffoe-Bonnie, with Judges Yaw Appau, Gabriel Pwamang, Issifu Omoro Tanko Amadu and Yonny Kulendi.
The embattled MP’s lawyer, who also serves as a law professor, held the view that Judge Wuni was trying all possible means to punish his client without regard to the procedures governing the handling of contempt cases. .
Speaking on Okay FM’s Ade Akye Abia morning show, attorney Kwame Gyan accused the High Court judge of deliberately making mistakes during the trial with the intention of punishing his client.
“When I realized that the judge was committing these infractions, I was alarmed and suspected … this plethora of infractions were clearly deliberate and serious, that if left unchecked can lead to a parody of justice … so I tried to convince him in the courtroom but he did not give in and that is why the legal team decided to seek the intervention of the Supreme Court to arrest the Judge …
“When we informed the judge of first instance of our decision, he said that he will still continue with the case, whether he has gone to the Supreme Court to arrest him or not,” he said.
He explained that the Supreme Court has supervisory powers over all decision-making bodies, including cases presided over by the National Chamber of Chiefs, if it receives a request that suggests that there is a deliberate error in the procedure of any case.
According to him, according to the court’s ruling, Mr. Agyapong is still being held in contempt for his alleged comments that scandalized the court and discredited his name.
The Clerk of the Superior Court has been asked to find another judge in the Superior Court to preside over the case against H.E. Kennedy Agyapong.
“We are waiting for the Clerk of the Superior Court to call us and tell us the court and the judge who has been assigned to preside over the case and as law-abiding attorneys, we will honor the Clerk’s invitation,” he said.
