Dzifa Gunu Files Conditional Appearance Notice in Anyidoho GH ¢ 10m Defamation Lawsuit

The defendant in the ¢ 10 million GH defamatory lawsuit filed by Koku Anyidoho, Atta-Mills Institute Founder Dzifa Gunu has filed a conditional appearance notice of entry.

This comes after the plaintiff, Koku Anyidoho, through a Substitute Service Court Order, delivered a GH ¢ 10 million defamation lawsuit to Dzifa Gunu, via the Daily Graphic.

Anyidoho, on January 28, 2021, filed a lawsuit against Dzifa Gunu in a High Court of Tema following his accusations against him.

Anyidoho in his claim statement said that Dzifa Gunu, an activist for the Democratic National Congress on January 16, 2021, made a post on Facebook in which he sought to discredit his character and image.

He said the NDC activist in the Facebook post accused him of attempting various attempts on the life of former President John Mahama, including visiting shrines in Benin to kill him.

Anyidoho further alleged that Dzifa Gunu accused him of killing his eight-year-old daughter.

“On January 16, 20201, the defendant posted an article on his Facebook page that threw serious insinuations about the plaintiff’s integrity and, in that post, the defendant made serious defamatory statements about the plaintiff.”

Furthermore, the defendant made serious defamatory statements about the plaintiff, namely (the plaintiff has attempted various attempts on the life of former President John Dramani Mahama by visiting shrines in Benin and Togo to cause the premature death of former President John Dramanai Mahama), a fact that he knew it was false. “

However, the defendant could not be notified after several attempts.

Mr. Anyidoho then instructed his attorneys to present a substitute service that the court granted.

The lawyers Awuku-Asabre Law Consult published on Tuesday, February 23, 2021, the edition of the Daily Graphic published the Substitute Service Order of the lawsuit.

The court ordered the defendant to appear for an appearance within eight days of service of the order, including the day of service.

The defendant was asked to note that, in the event of a failure to appear, the court may pass judgment on the matter in his absence without notice.

He has since filed an entry notice of conditional appearance through his attorney Godwin Edudzi Tamakloe.

Meanwhile, the plaintiff, Mr. Anyidoho, is seeking damages in the sum of GHC10 million for the defamatory statements posted by the defendant on his Facebook page.

He is also seeking, among other things, a perpetual court order prohibiting the defendant from publishing further defamatory material about him.

According to the conditional appearance, the defendant has not appeared in full and has not stated that his client has a defense.

The window opens for 14 days, after which a summary judgment will be issued assuming a full appearance has been filed.
