The president of the Electoral Commission, Jean Mensa, has backed the decision of the Speaker of Parliament, Professor Mike Oquaye, to expel the deputy of Fomena, Andrew Asiamah Amoah from the Chamber.
The EC reiterated the declaration of the president of the position of deputy of Fomena as vacant.
This expulsion occurs after the decision of the deputy of Fomena to become independent in the next December elections.
The President of the EC, making this pronouncement after her office received a letter from the Speaker of Parliament, said: “The Electoral Commission duly recognizes that, according to the Constitution of the Republic of Ghana, a member of Parliament on the list of a political party that decides to run for election as an independent candidate loses its position as a member of Parliament ”.
“As a result, by his decision to run and challenge the 2020 general election as an independent candidate, the Honorable Andrew Asiamah Amoako, Member of Parliament for the Fomena constituency in the Ashanti region, is no longer a member of Parliament. The Electoral Commission declares the position of Fomena vacant ”.
Jean Mensa also indicated that partial elections will not be held to replace the deputy due to the conditions of article 112 of the 1992 constitution.
He explained that “Article 112 (5) establishes that whenever a vacancy occurs in parliament, the Secretary of Parliament must notify the Electoral Commission in writing within seven days after the vacancy and partial elections will be held within thirty days after the vacancy. occurred … “
“However, according to article 112 (6) of the constitution, no by-elections will be held within the three months prior to the holding of a general election. As a result, the Electoral Commission cannot organize an election to replace the member of Parliament for Fomena ”.
The president of Parliament on Saturday, November 7, 2020, officially declared the seat of the deputy of Fomena vacant. He then wrote to the EC to notify the Commission of the action taken by parliament.
