The Alliance for Social Equity and Public Accountability (ASEPA) has asked the Office of the Special Prosecutor (OSP) to proceed with investigations into the Airbus scandal as required by law.
Mensah Thompson, ASEPA’s executive director, told reporters Thursday that the special counsel, Martin Amidu’s excuse for suspending investigations, lacks constitutional backing.
“There is no law in our constitution that prohibits the Special Prosecutor from investigating and prosecuting anyone for participating in an election.
“There is no provision in the Law of the Special Prosecutor that prevents anyone from being prosecuted for contesting the elections,” he said.
As part of a corruption risk assessment that Mr. Amidu presented to the president on the Agyapa Royalty Agreement, the former attorney general said he would have questioned NDC presidential candidate John Mahama had it not been for the upcoming election. .
Mr. Amidu revealed that the former president is the mysterious “government official 1” whose “brother is Samuel Adam Mahama” in the Airbus scandal.
But ASEPA finds that Mr. Amidu’s reason for withholding the questioning is just as ridiculous.
“If indeed the Special Prosecutor’s office has established that based on its investigations into the SFO report and other available documents attests that ‘Government Official 1’ is former President John Mahama, then the best action the Prosecutor can take Special is to investigate and prosecute the person.
“But for the Special Prosecutor to come out and tell us that because this person, who has identified himself as ‘Government Official 1’ in the Airbus scandal, is challenging an election and that is why his team has postponed the investigation and prosecution 2021 is unfounded, ”he said.
ASEPA also expressed dissatisfaction with Amidu for putting both the Agyapa deal and the Airbus scandal in a single report rather than treating them as separate cases.
This, said the Alliance, shows the incompetence of the Special Prosecutor.
“Recently, Mr. Amidu presented a report on the Agyapa transaction to the president, in that report he saw the need to insert a report on the Airbus scandal that he is also investigating, these reports are two different cases, so on what bases Mr. Martin Amidu inserted the report on the Airbus scandal into the corruption risk assessment report?
“As a concerned society organization, we would like you to reflect on why the Special Prosecutor will capture in that same report that the former president, John Mahama, should be exempt from the accusation of corruption because he is a political candidate for an important party,” he said. .
According to Mr. Thompson, the OSP’s mandate is to fight corruption, as such, Mr. Mahama should not be excluded from Airbus investigations if convicted.
