New Patriotic Party (NPP) general secretary John Boadu says that the party’s member of parliament for the Fomena constituency in the Ashanti region, Andrew Amoako Asiamah, has decided to participate in the 2020 parliamentary elections as a candidate independent, he is no longer a member of the party.
John Boadu, in a statement on October 13, 2020, said that by running as an independent candidate, Asiamah has lost her membership in the party under article 3 (9) of the party constitution.
He explained that, according to the party’s constitution, any party member who supports or campaigns for an independent parliamentary candidate before the next general election also automatically loses their membership in the PNP.
Boadu also said that the party has written to the Speaker of Parliament to notify him of Asiamah’s action and the fact that he is no longer a member of the PNP.
He cited article 97 (1) (g) of the 1992 Ghana Constitution, which states that “A member of Parliament shall vacate his seat in Parliament if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seek to remain in Parliament as an independent member. “
Below is the statement
The New Patriotic Party (PNP) wishes to notify the few Party members who decided to present themselves as Independent Parliamentary Candidates that they have automatically LOST their membership in the Party from the same day they presented it to the Electoral Commission (EC) for competition of conformity with article 3 (9) of the Constitution of the nuclear power plant.
Likewise, by this constitutional order, any member of the Party who supports or campaigns for an Independent Parliamentary Candidate before the next general elections also automatically loses his membership in the PNP.
The Party has noted that the Member of Parliament for the Fomena constituency in the Ashanti region, Hon. Amoako Andrew Asiamah, who was elected to Parliament on the Party’s ballot, has stood for the race as an Independent Parliamentary Candidate. In doing so, he has presumably vacated his seat in Parliament in accordance with article 97 (1) (g) of the 1992 Constitution of the Republic.
For the avoidance of doubt, Article 97 (1) (g) of the Constitution establishes that:
“A member of Parliament will vacate his seat in Parliament if he leaves the party of which he was a member at the time of his election to Parliament to join another party or if he wishes to remain in Parliament as an independent member.”
Therefore, the Party has taken the necessary measures to inform the President of Parliament of the above circumstances, so that appropriate measures are taken.
The PNP also wishes to take this opportunity to congratulate all Party members who had contemplated becoming Independents but reconsidered their decision in deference to the supreme interest of the Party. Such a display of loyalty and patriotism to the Party can never go unnoticed, and is duly recognized by the Party.
In particular, the Party salutes the Hon. Mercy Adu-Gyamfi, popularly known as Ama Sey, the Akwatia constituency deputy for heeding the wise advice and deciding not to run as an independent candidate but rather endorsing the party’s 2020 parliamentary candidate for Akwatia constituency Ernest Yaw Kumi, retain the Akwatia seat for the nuclear power plant.
The Party once again congratulates all former aspiring parliamentary candidates who, while unsuccessful in the Party’s 2020 parliamentary primaries, are heavily involved in campaigning for their respective parliamentary candidates before the general election.
Finally, the Party congratulates the 275 Party Parliamentary Candidates who successfully submitted their nominations to the Electoral Commission to compete in the 2020 Parliamentary Elections and wishes them the best of success in the elections. Without a doubt, the PNP is on track to maintain its overwhelming majority seats in the next Insha Allahu Parliament.
… Signed …
JOHN BOADU
GENERAL SECRETARY
