MTN Ghana withdraws legal case in dominance row

MTN Ghana pointed to a possible resolution in a row with the country’s communication authority on its alleged dominant position, and the operator withdrew a complaint filed with the Supreme Court.

MTN added that it believed the decision to end the legal proceedings was in the interest of shareholders, stakeholders and clients, noting that it hoped the move would “pave the way for further discussions and an amicable resolution, in the spirit of the renewed channels of participation “.

He also stressed that “collective goodwill” between the parties was necessary for the industry to prosper and help achieve the government’s goal of increasing connectivity in the country.

MTN filed a lawsuit with the country’s supreme court after losing an earlier superior court challenge to the regulator’s assessment of its position in the market.

The row surrounds the categorization of the MTN unit as Significant Market Power in the country by the National Communications Authority. The definition is designed to pave the way for government action to increase competition and curb the influence of the party that is considered to be in a dominant position.
