Nyantakyi’s lifetime ban reduced to 15 years, fined $ 100K

The Court of Arbitration for Sport (CAS) lowered the lifetime ban of former Ghana Football Association president Kwesi Nyantakyi to 15 years, Joy Sports may reveal.

The fine of 500,000 Swiss francs ($ 500,000) imposed on the former first vice president of the CAF was also reduced to 100,000 Swiss francs ($ 100,000) to be paid within 30 days of receipt of an arbitration award.

Earlier this week, a report from sister station Nhyira FM broke the news that the lifetime ban was lowered to 12 years, however the real figure is 15 years, additional verifications from the Multimedia sports team.

It will be recalled that the initial CAS decision went into effect on October 29, 2018, carrying the 15-year ban until 2033.

This means that Nyantakyi is banned from all soccer-related activities for 13 years, after having served two years.

Nyantakyi, on December 17, 2018, appealed a lifetime ban imposed in October 2018 by FIFA’s Independent Ethics Committee, following the release of a complaint about alleged corruption and match-fixing in June of the same year.

The case, which was registered as’ CAS 2018 / A / 6072 Kwesi Nyantakyi v. FIFA ‘in CAS system, resolved on April 9, 2020 based on Joy Sports controls in CAS.

The appeal was heard by the CAS panel on July 4, 2019, and partially confirmed the decision of the Adjudicatory Chamber of the FIFA Ethics Committee.

The CAS was expected to grant the decision on November 30, but Nyantakyi’s lawyers objected to the composition of the panel, claiming that one of the members had worked with FIFA and believed that a conflict of interest case may have arisen.

However, this objection was rejected and the final arbitration award was communicated to the parties on April 9, 2020, gathers Joy Sports.

The decision issued by the Adjudication Chamber of the FIFA Ethics Committee on October 29, 2018 was amended as follows:

“Kwesi Nyantakyi is prohibited from participating in any type of soccer-related activity at a national and international level (administrative, sports or any other) for a period of fifteen (15) years, starting October 29, 2018. Kwesi Nyantakyi fined the sum of 100,000 Swiss francs, to be paid within thirty (30) days following notification of the award ”.

Nyantakyi’s lawyers appear unhappy with the panel’s decision and are challenging it in the Swiss Federal Supreme Court.

They had argued that the bans of former FIFA and UEFA presidents, Joseph Sepp Blatter and Michel Platini, were eight and nine years respectively despite the seriousness of their offenses.

The CAS panel admitted that this argument was sound, but insisted that it had “discredited the image of football.”

For this reason, the lawyers are confident that the panel was unfair with its ruling and proceeded to the Swiss Supreme Court in May 2020 to overturn the CAS decision.

This move means that the current decision has been set aside, as the case will run its full course, with the documents resubmitted as it did before the CAS panel.

The CAS, in an email to Joy Sports, said: “The arbitration award is expected to be published in the CAS jurisprudence database in the coming weeks.”
