Scancom Plc. MTN Ghana operators have filed documents with the Supreme Court to review the recent High Court decision regarding MTN Ghana’s declaration as a Significant Market Power (SMP).
This step came on Friday after a careful review of the court’s ruling.
This comes after the High Court of Justice (Business Division) on September 1 dismissed MTN’s request for a judicial review of MTN Ghana’s National Communications Authority (NCA) declaration as SMP.
Telecoms giant MTN Ghana said its concerns regarding the National Communications Authority (NCA) declaring it a Significant Market Power (SMP) remain unresolved.
The company said that while it respects the High Court’s decision and has full confidence in the Ghanaian judiciary, it will announce its next course of action in the coming days.
The decision to declare MTN Ghana an SMP is in response to a directive from the Ministry of Communications to the NCA that seeks to address disparities in the market and revenue share in the telecommunications sector.
The Electronic Communications Act of 2008 (Law 775), which provides for the regulation of electronic communications, was to be applied by the NCA to guarantee fairness for all network operators in the industry.
Following the ruling, MTN Ghana said it recognizes the duty and powers of the National Communications Authority (NCA) to promote fair competition among licensed operators in Ghana’s telecommunications sector within relevant Ghanaian laws and best practices. acceptable in the global industry.
However, it indicated that it had challenged the NCA’s statement on procedural grounds, claiming that the Authority’s decision did not meet the requirements of procedural fairness.
