The Accra High Court has dismissed MTN’s case, which sought to have the court overturn the decision of the National Communications Authority (NCA) to classify it as a significant market player (SMP) in the telecommunications industry in Ghana.
The court in its session on Tuesday, September 1, 2020, dismissed MTN’s case and also awarded a cost of GH ¢ 10,000 against the giant mobile network company, according to the ruling that is available to Online chart.
The decision, Online chart understands means that the NCA can now take remedial action against MTN to promote competition, protect other mobile network operators and consumers.

As previously reported exclusively by Graphic Online’s court reporter, Emmanuel ebo hawkson, MTN’s legal action, which challenged the processes that led to it being classified by the NCA as a significant market player (SMP) in the telecommunications industry, was initiated in the Commercial Division of the Accra High Court.
MTN went to court with a request for judicial review urging the court to overturn the NCA’s decision on the grounds that the regulator did not grant it a hearing before classifying it as SMP.
The NCA, however, insisted on its affidavit in opposition to the request that at all relevant times, MTN was aware of and participated in the process that led to its qualification as SMP.
