Man who allegedly assaulted his girlfriend to death requests bail

Philip Caesar Kumah, the man who allegedly beat his girlfriend to death and was taken into police custody, has applied for bail in Ho High Court after appearing in Ho District Court.

Raymond Akpatsa, the defendant’s attorney, said they filed the bail request because they believed that the Superior Court, which was a higher court of the judiciary, had all the necessary jurisdiction to admit the defendant on bail.

He said that the Attorney General (AG) had not objected to his affidavit of motion to grant bail.

Akpatsa said that although the attorney general filed a response to his bail request, the response only prayed for strict bail conditions that would require the defendant to appear, whenever he was supposed to go to court.

The Superior Court deferred the ruling on the bail request until April 12, 2021.
The lawyer, however, said that if the High Court rejects the request, the next option would be to go to the Court of Appeal.

Meanwhile, the defendant has returned to police custody when he made his second appearance at Ho District Court.

The presiding judge, Mr. Robert Addo, postponed the case until April 7 of this year, to allow the prosecution to complete the investigations and make the necessary corrections to the charges and data sheets.

The defendant’s attorney said the judge’s directive to the prosecution to make the necessary amendment to the position and the fact sheets was correct.

He said that the defendant was charged with murder, however, “the charge sheet did not establish the key element of the murder, it rudely stated that it caused the death of the victim but all those ingredients were missing in the fact, the fact is very rare. “

He said that the brief fact that accompanied the accusation sheet also indicated that the police were continuing with the investigation and it was for this reason that they asked the court for the preventive detention of the accused.

The District Court also opined that since the case was already before the Superior Court and the bail request was pending, it would prefer to wait for the Superior Court’s ruling before knowing what the next step to take, the attorney said.
