The executive director of the Atta-Mills Institute and former deputy secretary general of the opposition National Democratic Congress (NDC), Koku Anyidoho has filed an ex-parte motion for a substituted service order on Dzifa Gunu, for whom he has sued defamation.
The plaintiff says that all efforts to serve the defendant in the defamation lawsuit have proven futile, so he is praying to the High Court to grant an order for the defendant to receive the summons.
Koku Anyidoho has brought a member of the opposition National Democratic Congress (NDC), Dzifa Gunu, to the High Court on charges that he (Anyidoho) murdered and used his 8-year-old daughter for ritual purposes.
The former deputy general secretary of the umbrella family in his complaint brief says that the defendant on January 16, 2021 published an article on his Facebook page and launched serious insinuations about his integrity.
However, the three attempts made by a court sheriff to serve the defendant have not yielded positive results.
Following this, the plaintiff has instructed his attorney Yaw Awuku Asabera to file an ex-party motion for substitute service.
It says it has reason to believe that the defendant is “deliberately evading the service of the Writ of Summons and Declaration of Claims to nullify the purposes of justice.”
It indicated in its supporting affidavits that it will be virtually impossible to deliver the documents personally to the defendant and that the only way to be notified is through the substituted delivery by pasting it at the courthouse and on the Daily Graphic.
The plaintiff has sued Gzifa Gunu for accusing him of killing his [Anyidoho] daughter for ritual purposes.
It is the case of the plaintiff that the defendant (Gunu) made a categorical statement that he (Anyidoho) caused the death of his 8-year-old daughter who died on November 7, 2021.
Mr. Anyidoho further claims that the defendant made a categorical statement that he (Anyidoho) was absent during the pre-burial, burial, and post-burial ceremonies of his late daughter.
He, among other things, claims that the defendant made these claims with malicious intent because he (Gunu) did not verify the veracity of his claims in his posts.
He said that the defendant published the complaints without any facts that justify the accusations of crime, illegality and dishonesty against the plaintiff, and furthermore, these accusations that are accused of him (Anyidoho) in the offending publication are baseless and false.
It added that the claims were made carelessly and recklessly with no excuse or legal justification and were calculated to damage the plaintiff’s reputation and expose him to public ridicule, hatred and contempt.
Therefore, it demands a sum of 10 million Ghana Cedis for the defamatory statements published on the defendant’s Facebook pages.
